Terms of Use

1. Acceptance of Terms

By downloading, installing, or using any Tangram Game Studio application, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, do not use our applications.

These terms are governed by Spanish and European legislation. Any dispute will be resolved by the competent courts of Spain.

3. Minimum Age and Capacity

Our applications are available to users of all ages. However:

  • Under 16 years: Must have the consent of their parents or legal guardians to use the application, especially regarding the processing of personal data under GDPR.
  • Under 18 years: To make in-app purchases, they must have authorization from their parents or legal guardians.
  • Adults: By using the application, you confirm that you have legal capacity to accept these terms.

4. License to Use

Tangram Game Studio grants you a limited, non-exclusive, non-transferable, and revocable license to download and use our applications on devices you own or control, subject to these terms.

You may NOT:

  • Copy, modify, distribute, sell, or rent the application or any part of it
  • Reverse engineer, decompile, or attempt to extract the application's source code
  • Use the application for commercial purposes without express authorization
  • Remove or alter any copyright notice, trademark, or other indication of ownership
  • Use cheats, exploits, unauthorized modifications, or any method to manipulate the application's functioning
  • Create derivative works based on the application
  • Use the application in a way that violates any applicable law or regulation

5. User Conduct

By using our applications, you agree to:

  • Use the application lawfully and in accordance with these terms
  • Not use cheats, hacks, or third-party tools to manipulate scores or results
  • Not interfere with the proper functioning of the application or related services
  • Not attempt to gain unauthorized access to systems, accounts, or data of other users
  • Not transmit viruses, malware, or malicious code
  • Not perform activities that may damage, disable, or overload our services
  • Respect the rights of other users and not engage in harassment, intimidation, or abusive behavior

Failure to comply with these rules may result in immediate termination of your access to the application without refund.

6. In-App Purchases

Some applications may offer in-app purchases. Purchases are processed through:

  • App Store (iOS): All purchases are subject to Apple's terms and conditions. Apple acts as the merchant for purchases.
  • Google Play (Android): All purchases are subject to Google's terms and conditions. Google acts as the merchant for purchases.

Refund Policy:

  • In-app purchases are generally non-refundable, except when required by law (e.g., right of withdrawal in the EU for digital purchases in certain cases).
  • If you have issues with a purchase, you must contact Apple (App Store) or Google (Google Play) directly, as applicable.
  • In Spain, consumers have a 14-day right of withdrawal for digital purchases under Directive 2011/83/EU, except when digital content has been delivered immediately and you have given your express consent.
  • Refunds will be processed according to Apple's or Google's policies and applicable legislation.

Value of Virtual Items: Virtual items, currencies, and content within the application have no real monetary value and cannot be exchanged for real currency, transferred to other accounts, or refunded in cash.

7. Advertising

Our applications may display third-party advertising through Google AdMob. Advertising may be:

  • Personalized: Based on your interests and behavior (with your consent)
  • Non-personalized: Based on the application context

You can manage your advertising preferences in your device settings. We are not responsible for the content of third-party advertisements or the privacy practices of advertisers.

8. Intellectual Property

All intellectual property rights in the applications, including but not limited to:

  • Design, graphics, music, sounds, and effects
  • Source code and object code
  • Trademarks, logos, and trade names
  • Content, features, and functionalities

Are the exclusive property of Javier Campaña Pulido (Tangram Game Studio) and are protected by copyright, trademark, and other intellectual property laws of Spain, the European Union, and internationally.

You do not acquire any ownership rights in the application by downloading or using it. All rights not expressly granted in these terms are reserved.

9. Service Availability

We strive to keep our applications available and functioning properly. However:

  • We do not guarantee that applications will be available continuously or error-free
  • We may perform scheduled or emergency maintenance that may result in temporary interruptions
  • We do not guarantee compatibility with all devices or operating system versions
  • We may modify, update, or discontinue any aspect of the application at any time

10. Warranty Disclaimer

The applications are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to:

  • Merchantability warranties
  • Fitness for a particular purpose
  • Non-infringement of third-party rights
  • Absence of errors or interruptions

This disclaimer applies to the maximum extent permitted by applicable law. However, this disclaimer does not affect your legal rights as a consumer under Spanish and European legislation.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Javier Campaña Pulido (Tangram Game Studio) shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of data, profits, revenue, or business opportunities
  • Damages resulting from the use or inability to use the application
  • Damages resulting from the conduct of third parties, including other users

Important: This limitation does not affect your right as a consumer to receive compensation for direct damages caused by application defects under Spanish and European consumer protection legislation.

Our total liability to you for any claim related to the application shall not exceed the amount you have paid for the application in the last 12 months, or 50 euros, whichever is greater.

12. Termination

By you: You may stop using the application at any time by uninstalling it from your device.

By us: We reserve the right to terminate or suspend your access to the application at any time, without prior notice, for any reason, including but not limited to:

  • Violation of these terms of use
  • Fraudulent, illegal, or abusive use of the application
  • Activities that may damage our reputation or that of other users
  • Legal or regulatory requirements

In case of termination, you will not be entitled to any refund, except when required by law.

13. Modifications to Terms

We reserve the right to modify these terms at any time. We will notify you of significant changes through:

  • Updating the "Last updated" date on this page
  • Notification in the application (if the change is substantial)

Continued use of the application after changes take effect constitutes your acceptance of the new terms. If you do not agree with the changes, you must stop using the application.

14. Dispute Resolution and Applicable Law

Applicable Law: These terms are governed and interpreted in accordance with the laws of Spain, without regard to its conflict of law provisions.

Dispute Resolution:

  • As a consumer in the EU, you have the right to file a complaint with the EU online dispute resolution platform: https://ec.europa.eu/consumers/odr
  • You may also file a complaint with Spanish consumer authorities
  • For disputes that cannot be resolved amicably, the parties submit to the courts and tribunals of the consumer's domicile or our domicile, at the consumer's choice

15. General Provisions

Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver: Our failure to exercise any right under these terms does not constitute a waiver of that right.

Assignment: You may not assign or transfer these terms or your rights under these terms without our prior written consent. We may assign these terms without restrictions.

Entire Agreement: These terms constitute the entire agreement between you and Javier Campaña Pulido (Tangram Game Studio) regarding the use of the application and replace all prior agreements.
